inbiciveritas.it is the official website of Cicli Varsalona SRL. Through the site, users can browse information about the brands we carry and purchase products online.
User-Provided Content
Users are solely responsible for any content, including that of third parties, they upload or share on inbiciveritas.it. This includes content submitted through uploads, form submissions, or any other means.
Users shall hold the Owner harmless from any liability arising from the unlawful distribution of third-party content or the use of inbiciveritas.it in ways that violate applicable laws.

User Registration
To use the service or parts of it, users must register by providing accurate and complete information through the registration form, and must fully accept both the Privacy Policy and these Terms and Conditions.
Users are responsible for safeguarding their login credentials and keeping them confidential.
Purchasing
Purchase Procedure
Each order submitted constitutes an offer to purchase one or more products.
Orders are subject to the availability and acceptance by the Owner.
To place an order, users must:

Carefully review and, if necessary, modify the order summary information;

Confirm the order and make payment, including any applicable taxes and shipping/handling fees listed in the order summary.
The Order Processing Receipt does not represent order acceptance.
The contract is finalized only when the Owner sends an Order Confirmation email to the address provided by the user.
The Owner reserves the right to decline an order, notifying the user via email within 15 days of the purchase if one or more items are unavailable. In this case, the Owner will issue a full refund of the purchase price and shipping costs.
For orders shipped within Italy, the user must request an invoice at the time of purchase. If no such request is made, a sales receipt will be issued instead, and invoices cannot be requested retroactively.
Product Availability
Prices, descriptions, and product availability may change without prior notice.
Images are provided for reference only and do not constitute a guarantee of product characteristics.
Order Fulfillment
Orders are fulfilled within the timeframe specified in the order summary page and in the Order Confirmation email, subject to product availability.
The Owner shall not be held liable for any damages resulting from delivery delays that were not foreseeable at the time the Order Confirmation was sent.
Shipping and Delivery
Deliveries are made during regular business hours to the address provided by the user, following the method specified in the order summary.
Upon delivery, users must verify the contents and report any issues by noting them on the delivery form.
If the user fails to collect the package within the time specified by the courier, the products will be returned to the Owner. In this case, the Owner will refund the product cost, excluding shipping charges.
The Owner shall not be liable for:

Errors in delivery due to incorrect or incomplete order information provided by the user;

Damage to the products occurring after handoff to the courier (if the courier was chosen and appointed by the user);

Delays in delivery caused by the user.
Right of Withdrawal
When purchasing goods or services on inbiciveritas.it, users have the right to withdraw from the contract without providing any reason, within 14 days.
The withdrawal period expires 14 days after the day the user or a third party—other than the courier—takes physical possession of the goods.
To exercise the right of withdrawal, users must inform the Owner of their decision by sending an explicit declaration using the contact details provided.
Effects of Withdrawal
If the user withdraws from the contract, the Owner will refund all payments received from the user, excluding shipping costs, without undue delay and in any case no later than 14 days from the date on which the Owner is informed of the decision to withdraw.
The refund will be issued using the same payment method used for the original transaction, unless otherwise agreed. The user will not incur any additional fees as a result of the refund.
The refund may be withheld until:

The returned goods are received by the Owner, or
-
The user provides proof of having returned the goods (whichever occurs first).
The user must return the goods to the Owner without undue delay, and in any event within 14 days from the date of withdrawal notification.
This deadline is considered met if the goods are shipped back before the 14-day period expires.
Return shipping costs are the responsibility of the user.
The user is liable for any decrease in value of the goods resulting from handling other than what is necessary to determine their nature, characteristics, and functioning.
Limitations to the Right of Withdrawal
Products that are damaged or even partially used cannot be returned or refunded.
The user must include a copy of the original delivery document inside the return package.
The right of withdrawal does not apply to:

Custom-made or clearly personalized goods;

Goods that are likely to deteriorate rapidly;

Sealed items that are not suitable for return for health or hygiene reasons and have been opened after delivery.
Warranty
Consumers are entitled to a legal warranty for the conformity of goods and services purchased.
This warranty is valid for 24 months from the date of delivery, and any lack of conformity must be reported to the Owner within 2 months of discovery.
To claim warranty service, users must:

Send an email to the Owner

Include the order number and a detailed description of the defect (photographic documentation is recommended)
All the above elements are essential and will be verified by the Owner before proceeding.
If a conformity defect is confirmed, the user has the right to:

A repair or replacement of the defective product, upon return of the item to the Owner.
In cases where:

Repair or replacement is impossible or excessively expensive,

The Owner does not act within a reasonable timeframe, or
-
A previous repair/replacement caused significant inconvenience to the user,
the user has the right to request a price reduction or termination of the contract.

Service Interruption
The Owner reserves the right to:

Add or remove features

Suspend or discontinue the service, either temporarily or permanently
In the event of a permanent discontinuation, the Owner will make every effort to allow users to retrieve any data hosted on the platform.
Resale of the Service
Users are not permitted to reproduce, duplicate, copy, sell, resell, or exploit any portion of inbiciveritas.it or its services without express written permission from the Owner, whether directly or through a specific reseller program.
Indemnity
The user agrees to indemnify and hold harmless the Owner (including its affiliates, representatives, directors, agents, licensees, partners, and employees) from any obligation or liability, including legal fees incurred in defending against claims, arising from:

Age Requirements
Users declare that they are of legal age under the applicable laws.
Minors may only use inbiciveritas.it with the assistance of a parent or legal guardian.
Limitations of Liability
To the maximum extent permitted by applicable law, the Owner shall be liable for damages — whether contractual or non-contractual — only in cases of willful misconduct or gross negligence, and only when such damages are a direct and immediate consequence of the Owner’s activities on inbiciveritas.it.
Users expressly release the Owner from any liability, to the extent allowed by applicable law, for any direct, indirect, incidental, special, or consequential damages, including:

Changes to These Terms
The Owner reserves the right to modify these Terms at any time by publishing the updated version on inbiciveritas.it.
Users who continue to use inbiciveritas.it after the updated Terms are published accept the new Terms without reservation.
Assignment of Contract
The Owner reserves the right to transfer or assign any rights or obligations under these Terms, provided that the user’s rights are not affected.
Users may not assign or transfer their own rights or obligations under these Terms without prior written consent from the Owner.
Communication
All communications relating to inbiciveritas.it must be sent using the contact information provided in this document.
Severability
If any provision of these Terms is deemed invalid, unlawful, or unenforceable, such provision shall be removed without affecting the validity and enforceability of the remaining provisions.
Applicable Law and Jurisdiction
These Terms and any disputes related to their execution, interpretation, or validity shall be governed by the laws and jurisdiction of the country where the Owner is based.
If the law provides for consumer jurisdiction, the consumer's place of residence shall prevail.
Online Dispute Resolution for Consumers
The European Commission provides an online platform for alternative dispute resolution (ODR), which allows EU consumers to resolve disputes related to online purchases without going to court.
If you are an EU consumer, you can use this platform to resolve disputes related to contracts entered into with the Owner.
