General Terms of Service

Users who access the services offered by In Bici Veritas – Cicli Varsalona acknowledge and agree to these general terms and conditions.

User Registration

To access the Service or part of it, users must register with accurate and complete information and accept the Privacy Policy and these Terms in full. Users are responsible for keeping their login credentials confidential.


Purchasing Process

Each order submitted is an offer to purchase the selected products. Orders are subject to availability and acceptance by the Owner.

To place an order:

  • Select products

  • Review the order summary

  • Confirm and proceed with payment

The Order Processing Receipt does not constitute acceptance. The contract is finalized upon the Owner’s Order Confirmation sent by email.

If any item is unavailable, the Owner may notify the user within 15 days and:

  • Offer a replacement

  • Suggest waiting for restock

  • Issue a partial or full refund

In Italy, invoices must be requested at the time of purchase. Otherwise, a receipt will be issued and no invoice can be requested later.

Product Availability

Prices, descriptions, and availability of the products shown on the website may change without notice.
Product images are provided for illustrative purposes only and do not constitute a guarantee of product characteristics.


Order Fulfillment

Orders are fulfilled within the timeframes specified on the order summary page and in the Order Confirmation email, subject to product availability.

The Owner is not responsible for damages caused by delivery delays that could not be foreseen at the time of the Order Confirmation.


Delivery

Deliveries are made during regular business hours to the address provided by the user, according to the method outlined in the order summary.

Upon delivery, the user must inspect the package and indicate any issues on the courier’s delivery form.

If the package is not collected within the courier’s time limit, it will be returned to the Owner. In this case, the Owner will refund the product cost but not the shipping fees.

The Owner is not responsible for:

  • Delivery errors due to inaccurate or incomplete order information provided by the user;

  • Damage occurring after the package has been handed over to a courier chosen by the user;

  • Delivery delays caused by the user.


Right of Withdrawal

The user has the right to withdraw from the contract without giving a reason, within 14 days of receiving the goods (or from when a third party appointed by the user takes possession).

To exercise this right, the user must notify the Owner via an explicit statement sent to the contact details provided.


Effects of Withdrawal

If the user withdraws from the contract, the Owner will refund all payments made, excluding delivery costs, within 14 days from the date the Owner is informed of the decision.

Refunds will be made using the same payment method used for the original transaction, unless otherwise agreed. No fees will be charged for the refund.

The refund may be withheld until:

  • The goods are received back, or

  • Proof is provided that the goods were returned,
    whichever comes first.

The user must return the goods within 14 days of the withdrawal notice. Return shipping is at the user's expense.
The user is responsible for any loss in value due to handling beyond what is necessary to determine the nature, characteristics, and functioning of the goods.


Limitations to the Right of Withdrawal

Used or damaged products, even partially, will not be accepted for return or refund.

The user must include a copy of the delivery note inside the return package.

The right of withdrawal does not apply to:

  • Custom or personalized products;

  • Perishable items;

  • Sealed goods that are not suitable for return for hygiene or health protection reasons and have been unsealed after delivery.

    Warranty

    Consumers are entitled to a legal warranty covering the conformity of goods and services purchased.
    This warranty is valid for 24 months from the delivery date and must be claimed within 2 months from discovery of the defect.

    To activate the warranty, the user must:

    • Send an email to the Owner

    • Include the order number and a detailed description of the defect

    • (Photographic evidence is recommended)

    All elements are essential and will be reviewed before a response is provided.

    If a defect is confirmed, the user is entitled to:

    • Repair or replacement of the defective product (upon return to the Owner)

    If repair or replacement is:

    • Impossible or excessively costly

    • Not carried out within a reasonable time

    • Inconvenient to the user

    Then the user may request a price reduction or contract termination.

    Service Interruption

    The Owner reserves the right to:

    • Add or remove features

    • Temporarily or permanently suspend the service

    In the case of permanent suspension, the Owner will make efforts to allow users to retrieve their data.


    Resale of the Service

    Users may not reproduce, copy, sell, or resell any portion of inbiciveritas.it or its services without express written consent from the Owner or participation in an official reseller program.


    Indemnity

    The user agrees to indemnify and hold harmless the Owner and its affiliates, directors, agents, licensees, partners, and employees from any liabilities or claims—including legal fees—arising from:

    • Content uploaded by the user

    • Violations of laws or these Terms

    • Damages caused to other users or third parties


    Limitation of Liability

    To the fullest extent permitted by law, the Owner is liable only for damages caused by gross negligence or willful misconduct, and only if those damages are a direct and immediate consequence of the activities of inbiciveritas.it.

    Users expressly release the Owner from all other forms of liability, including but not limited to:

    • Direct or indirect damages

    • Punitive damages

    • Loss of profit or revenue

    • Data loss

    • Replacement or recovery costs
      arising from or related to this agreement.

Age Requirements

Users declare that they are of legal age according to the laws applicable in their country.
Minors may use inbiciveritas.it only with the supervision of a parent or legal guardian.


Changes to These Terms

The Owner reserves the right to modify these Terms at any time by publishing an updated version on ciclivarsalona.com.

Users who continue to use inbiciveritas.it after the updated Terms have been published are deemed to accept the changes without reservation.


Assignment of Contract

The Owner reserves the right to transfer, assign, or subcontract any of the rights or obligations under these Terms, provided that user rights are not affected.

Users may not transfer their rights or obligations under these Terms without prior written consent from the Owner.

If applicable, the consumer’s local court will have exclusive jurisdiction, in accordance with consumer protection law.

If you are an EU consumer, you may use this platform to resolve disputes related to online purchases without going to court.
